A patent lawyer sought a Mechanical Engineer expert to provide an independent opinion on the mechanical design of thermoformed fresh produce punnets.
We provided a Mechanical Engineer with previous experience giving evidence in patent cases for thermoforming plastics. The expert has appeared as an expert witness and presented evidence before the Supreme Court of Victoria and the Federal Court of Australia.
The expert’s evidence assisted the court in determining that the design for the fresh produce punnets was novel and was not reproducible by a third party with only general knowledge.
The expert provided testimony in court and the respondent attempted to criticise the expert’s expertise and methodology. However, the judge rejected the criticisms and commended the expert’s professionalism in the witness box.
